Mariupol residents are entitled to compensation for destroyed housing!

Thanks to the initiative of the President of Ukraine Volodymyr Zelenskyy, the Law of Ukraine "On Compensation for Damage and Destruction of Certain Categories of Real Estate as a Result of Hostilities, Terrorist Acts, Sabotage Caused by the Armed Aggression of the Russian Federation against Ukraine, and the State Register of Property Damaged and Destroyed as a Result of Hostilities, Terrorist Acts, Sabotage Caused by the Armed Aggression of the Russian Federation against Ukraine" No. 2923 came into force, which provides for compensation to owners of damaged and destroyed property.
The procedure for providing compensation for destroyed real estate and the calculation of the amount of compensation is regulated by CMU Resolution No. 600 of May 30, 2023.
The procedure for granting compensation for the restoration of certain categories of real estate damaged as a result of hostilities, terrorist acts, sabotage caused by the armed aggression of the Russian Federation using the electronic public service "eVidnovlennya" is provided for by CMU Resolution No. 381 of April 21, 2023, which applies to objects located in the non-occupied territories.
By the decision of the Executive Committee of the Mariupol City Council of 29.06.2023 No. 82, the Commission for consideration of issues related to compensation for destroyed real estate on the territory of the Mariupol City Territorial Community as a result of hostilities, terrorist acts, sabotage caused by the armed aggression of the Russian Federation against Ukraine was established. At the suggestion of the Ministry of Communities, Territories and Infrastructure Development,in order to establish the fact of the destruction of certain categories of real estate in the temporarily occupied territories and to provide compensation to their owners, the Cabinet of Ministers of Ukraine adopted Resolution No. 1185 of October 27, 2023 "On the Implementation of a Pilot Project to Conduct a Survey of Destroyed Certain Categories of Real Estate, in Particular Using Remote Sensing Information Products".
The Ministry of Infrastructure recognized the pilot project to inspect destroyed property in Melitopol as successful. The Government is expected to make a corresponding decision for all occupied territories.
Mariupol Mayor Vadym Boichenko, defending the interests of Mariupol residents, submitted proposals to the Ministry of Reintegration for the Government to make a decision, according to which residents of the temporarily occupied territories will also be able to receive compensation for destroyed housing without waiting for the city to be de-occupied.
- In addition, Vadym Boichenko's team is doing everything possible to ensure that Mariupol residents receive fair compensation for their housing. While a decision from the Government is awaited:
- public registrars of the city council process information reports on damage/destruction of housing - residential houses and apartments of Mariupol residents are entered into the register of damaged and destroyed property;
- the network of support centers I`Mariupol has created comfortable conditions for obtaining advice on the preparation of legal documents that will be necessary to receive state compensation.
Thus, the Mariupol City Council helps residents prepare for the process of applying for compensation in advance.
The I`Mariupol centers are staffed by administrators of the Mariupol ASC, and the following services are available:
- Submit an information report on destroyed/damaged housing;
- Get advice on the restoration of ownership documents and support in the process of obtaining documents confirming ownership and property characteristics;
- Check the completeness of available documents for further application for compensation for destroyed housing;
- Get advice on registration of property rights in the State Register of Property Rights, get a roadmap of step-by-step actions in the registration process;
- To fill out a survey for owners of damaged non-residential and commercial real estate and owners of damaged private sector houses to enter data into the register of damaged and destroyed property (RDDP). This data can also be submitted online:

In the current situation, while the city is under temporary occupation, the right to receive compensation can be realized if the high-rise building is completely demolished. Only in this way will the commission have the right to confirm the fact of destruction. In other situations, it is necessary to inspect the building after the city is de-occupied.
As the territory is occupied, the Mariupol City Council is currently unable to document the damage/destruction of residential buildings. However, based on the available satellite images as of 15.05.2023, a list of dismantled buildings was compiled.
